These Terms of Service (“Terms”) govern your access to and use of the Jobbir website available at jobbir.com (the “Site”) and the related online applicant tracking system and job posting services (the “Services”).
The Services are operated by IT SERVICES & HUMAN JOB TALENT S.R.L., a company established in the Republic of San Marino, with registered office at Via Consiglio dei Sessanta, 99 Dogana, Republic of San Marino (“Jobbir”, “we”, “us” or “our”).
By creating an account, accessing or using the Site or Services, you agree to be bound by these Terms. If you are using the Services on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and “Client”, “you” or “your” will refer to that entity.
If you do not agree to these Terms, you must not access or use the Site or Services.
Jobbir provides an online applicant tracking system (ATS) that allows Clients to:
The Services are provided remotely via the internet. Jobbir acts solely as a technology provider that enables Clients to create, manage and distribute job postings and to receive and organize Candidate applications. Jobbir is not an employer, recruiter, staffing agency, or employment agency and does not participate in hiring decisions or candidate selection. Jobbir does not provide legal, tax, or professional HR consulting advice. Clients remain solely responsible for their recruiting processes, compliance obligations, and hiring decisions.
Job Posting Distribution. As part of the Services, Clients may choose to distribute job postings to third-party job boards, recruitment platforms, or social networks through integrations, APIs, or intermediary systems operated by Jobbir or its partners. Such distribution is performed on behalf of the Client and subject to the policies, terms, and technical requirements of the applicable third-party platform.
You may use the Services only if you:
We may refuse, suspend or terminate access to the Services at any time where permitted by applicable law.
Account Registration. To access certain features, you must create an account and provide accurate, current and complete information. You agree to keep your account information up to date.
Credentials. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, including activities conducted by Client Users.
Security Notice. You must promptly notify Jobbir at [email protected] (or [email protected]) of any unauthorized access, suspected compromise of credentials, or other security incident related to your account.
Account Administration. Clients are responsible for managing permissions and access rights of their Client Users.
Subscription Plans. Access to the Services for Clients is offered on a paid Subscription basis. Subscription features and pricing are described on the Site or in a written order form/proposal.
Fees. Unless expressly stated otherwise in writing, Subscription fees are charged in advance for the applicable subscription period and are non-refundable, except where required by applicable law.
Payment Processing. Payments may be processed via third-party payment processors (including PayPal and card payment providers). By submitting payment information, you authorize Jobbir and its payment processors to charge the applicable fees using your selected payment method. Jobbir does not store full credit/debit card numbers or CVV codes on its own servers.
Taxes. Fees do not include taxes, duties, or government assessments. You are responsible for all applicable taxes related to your purchase, excluding taxes based solely on Jobbir’s net income.
Non-payment. If payment is not received when due, Jobbir may suspend or terminate access to the Services until payment is received.
Term. These Terms remain in effect while you access or use the Services or maintain an account.
Cancellation by Client. Clients may cancel a Subscription through account settings or by contacting Jobbir. Unless otherwise stated, cancellation takes effect at the end of the then-current subscription period.
Suspension or Termination by Jobbir. Jobbir may suspend or terminate access to the Services immediately (in whole or in part) if:

Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and governing law) will survive.
Client Responsibility. Clients are solely responsible for:
Ownership. As between Jobbir and the Client, the Client retains all rights to Client Data. Candidates retain rights in their CVs and application materials, subject to any agreements between Candidates and Clients.
License to Jobbir. You grant Jobbir a non-exclusive, worldwide, royalty-free license to host, store, transmit, process and display Client Data solely as necessary to provide, maintain, secure, and improve the Services, and to comply with legal obligations.
No Bulk Export; CV Download Allowed. Jobbir does not provide a feature to export Candidate data or application databases in bulk. Clients may download individual CV files and candidate documents available within the Services during the Subscription term, subject to the Client’s account permissions and access controls.
Candidate CVs and application data stored in Jobbir are retained for the duration of the Client’s active Subscription and as necessary for recruiting purposes.
After a Subscription expires or is terminated, Jobbir will delete or anonymize Candidate CVs and application data within thirty (30) days, unless a longer retention period is:
Clients are responsible for downloading any individual CVs they wish to retain prior to the end of the Subscription term.
Candidates may use the Services to submit CVs and applications and to communicate with Clients through the platform. Candidates are responsible for the accuracy of the information they provide.
Candidates must not include Social Security Numbers, full payment card details, bank account numbers, medical information, or other highly sensitive personal data in CVs, cover letters, or application documents submitted through the Services.
Third-party applications. If a Candidate applies through a third-party platform (including job boards, recruitment platforms, or social networks), the third party may collect and process Candidate information under its own policies and practices. Jobbir is not responsible for third-party platforms’ data processing or practices. Candidates should review the privacy policies and terms of the third-party platform they use to apply.
You agree not to:
Jobbir may remove content, restrict features, or suspend/terminate accounts that violate these Terms or that Jobbir reasonably believes may cause harm or risk.
The Site, Services, software, and all related materials (excluding Client Data and Candidate-submitted content) are owned by Jobbir or its licensors and are protected by intellectual property laws.
Subject to your compliance with these Terms and payment of applicable fees, Jobbir grants Clients a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for internal business recruiting purposes during the Subscription term.
The Services may integrate with or link to third-party services, platforms, or technologies (including job boards, recruitment platforms, social networks, payment processors, or other software providers). Jobbir does not control and is not responsible for the operation, availability, policies, or practices of third-party services. Your use of third-party services is subject to their own terms and policies.

Exclusion of Certain Damages. Jobbir will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenues, business, data, goodwill, or anticipated savings, arising out of or relating to the Services or these Terms.
Liability Cap. Jobbir’s total aggregate liability arising out of or relating to the Services or these Terms will not exceed the total amounts actually paid by the Client to Jobbir for the Services during the twelve (12) months preceding the event giving rise to the claim.
Free Use. If you use the Services without a paid Subscription, Jobbir’s total liability will not exceed USD 100 (or equivalent).
Some jurisdictions do not allow certain limitations; in those jurisdictions, liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend and hold harmless Jobbir and its affiliates, directors, officers, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or related to:
Jobbir may update the Services or these Terms from time to time. If we make material changes to these Terms, we will update the “Last updated” date and may provide additional notice via the Services or by email. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Services and cancel any active Subscription.
These Terms and any dispute arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the Republic of San Marino, without regard to conflict-of-law principles.
You agree that the courts of the Republic of San Marino will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and you consent to the personal jurisdiction of such courts.
